Drug charges dismissed

A judge in Golden Provincial Court acquitted one Mr. Tessmer's client earlier today on a charge of possession for the purposes of trafficking.

The client had been driving a rental vehicle from Alberta across the border and was stopped in Golden where it was discovered that he had four large duffle bags of marijuana in his trunk.  The officer found these drugs after questioning the driver in breach of his Charter rights.  Despite this, the judge initially admitted the drugs into evidence at trial, but ultimately found that the prosecution did not prove beyond a reasonable doubt that the driver in fact knew the drugs were there despite nobody else being in the vehicle.  Great win!
